This term means “ In complete agreement of mind ”. In any contract the parties must be ad idem - of the same mind – as to the subject-matter of the contract. The law therefore imposes on the proposer the duty of utmost good faith or uberrima fides. The proposer thus has a duty to disclose all material facts to the insurer. The insurer must also observe uberrima fides. By this means the party can be ad idem as to the risk proposed.
